الشروط العامة والوصول للخدمة

  • نحتفظ بالحق في رفض تقديم الخدمة لأي شخص لأي سبب وفي أي وقت.
  • أنت تدرك أن المحتوى الخاص بك (باستثناء معلومات بطاقة الائتمان)، قد يتم نقله غير مشفر ويتضمن (أ) عمليات نقل عبر شبكات مختلفة؛ و (ب) تغييرات للتوافق والتكيف مع المتطلبات الفنية لتوصيل الشبكات أو الأجهزة. يتم دائماً تشفير معلومات بطاقة الائتمان أثناء النقل عبر الشبكات.
  • أنت توافق على عدم إعادة إنتاج أو تكرار أو نسخ أو بيع أو إعادة بيع أو استغلال أي جزء من الخدمة أو استخدامها أو الوصول إليها أو أي جهة اتصال على الموقع الإلكتروني دون إذن كتابي صريح من جانبنا.

التعديلات على الخدمة والأسعار

  • أسعار منتجاتنا عرضة للتغيير دون إشعار مسبق.
  • نحتفظ بالحق في تعديل أو إيقاف الخدمة (أو أي جزء أو محتوى منها) دون إشعار في أي وقت.
  • لا نتحمل المسؤولية تجاهك أو تجاه أي طرف ثالث عن أي تعديل أو تغيير في الأسعار أو تعليق أو إيقاف للخدمة.
  • نحتفظ بالحق، دون التزام، في الحد من مبيعات منتجاتنا أو خدماتنا لأي شخص أو منطقة جغرافية أو ولاية قضائية، ويجوز لنا ممارسة هذا الحق على أساس كل حالة على حدة.
  • لا نضمن أن جودة أي منتجات أو خدمات أو معلومات أو مواد أخرى تشتريها أو تحصل عليها ستلبي توقعاتك، أو أنه سيتم تصحيح أي أخطاء في الخدمة.
  • نحتفظ بالحق في رفض أي طلب تضعه لدينا. ويجوز لنا، وفقاً لتقديرنا الخاص، تحديد أو إلغاء الكميات المشتراة لكل شخص أو لكل أسرة أو لكل طلب.

أدوات الطرف الثالث وتعليقات المستخدمين

  • قد نوفر لك إمكانية الوصول إلى أدوات تابعة لجهات خارجية والتي لا نراقبها ولا نملك أي سيطرة أو مدخلات عليها. أنت تقر وتوافق على أننا نوفر الوصول إلى هذه الأدوات "كما هي" و"كما هي متاحة" دون أي ضمانات.
  • أي استخدام من جانبك للأدوات الاختيارية المقدمة عبر الموقع يكون على مسؤوليتك الخاصة وتقديرك بالكامل.
  • إذا قمت بإرسال أفكار إبداعية أو اقتراحات أو مقترحات أو خطط أو مواد أخرى بناءً على طلبنا أو دونه، فإنك توافق على أنه يجوز لنا في أي وقت ودون قيود تعديل أو نسخ أو نشر أو توزيع أو ترجمة أو استخدام تلك التعليقات في أي وسيط.
  • يجوز لنا، ولكن لا نلتزم بذلك، مراقبة أو تعديل أو إزالة المحتوى الذي نحدد وفقاً لتقديرنا الخاص أنه غير قانوني أو مسيء أو مهدد أو تشهيري أو ينتهك الملكية الفكرية لأي طرف.

إخلاء المسؤولية الميكانيكية وبرمجة السيارات (ECU)

  • للاستخدام خارج الطرق العامة / سباقات الحلبات فقط: قد لا تتوافق عمليات فك تشفير وتعديل وحدة التحكم (ECU Unlocking/Tuning) مع القوانين الفيدرالية والمحلية. يتحمل العميل المسؤولية الكاملة لضمان توافق أي تعديلات على المركبة مع القوانين المعمول بها لاستخدام الطرق، خاصة فيما يتعلق بالسلامة والانبعاثات. لا نتحمل مسؤولية اعتبار سيارتك غير صالحة للسير من قبل السلطات المحلية بسبب التعديل.
  • لا يؤثر فك تشفير (ECU) على تشغيل مركبتك الأساسي. إذا ظهرت مشكلة في سيارتك بعد عملنا، فمن المرجح أن يكون ذلك بسبب عطل ميكانيكي أو خطأ في التركيب، وليس بسبب خدمة فك التشفير ذاتها.
  • يتحمل العميل مسؤولية التأكد من أن وحدة (ECU) المرسلة في حالة عمل ممتازة ولم يتم فتحها أو العبث بها ميكانيكياً.
  • أي ضرر غير متوقع يحدث أثناء العملية أو بعدها لا يتم تغطيته أو ضمانه من قبل FBO أو وكلائها المعتمدين.
  • لا نقبل استرجاع الأموال (Refunds are not accepted). لا نقدم أي ضمان ضمني لأي مكونات في سيارتك قبل أو بعد العملية، ولا نتحمل أي مسؤولية عن تعطل الأجزاء الميكانيكية أو الكهربائية بعد الانتهاء من خدمتنا.
  • العميل يقر بأن FBO أو وكلائها المعتمدين غير مسؤولين عن تكاليف التأخير المرتبطة بالشحن وأوقات التسليم.
  • تحدد الشركة المصنعة الأصلية للمركبة قراراتها الخاصة بتأثير المنتجات/الخدمات الإضافية على ضماناتها. FBO غير مسؤولة بأي شكل من الأشكال عن أي شيء يتعلق بضمان الشركة المصنعة الأصلية للسيارة أو يلغيه.

تحديد المسؤولية العامة

  • لا نضمن أو نمثل أو نصرح بأن استخدامك لخدمتنا سيكون دون انقطاع أو في الوقت المناسب أو آمناً أو خالياً من الأخطاء.
  • أنت توافق صراحة على أن استخدامك للخدمة أو عدم قدرتك على استخدامها يقع على مسؤوليتك وحدك. الخدمة وجميع المنتجات تقدم "كما هي" و"كما هي متاحة".
  • لا تتحمل FBO أو مدرائنا أو موظفونا أو شركاتنا التابعة أو وكلاؤنا أو موردونا بأي حال من الأحوال المسؤولية عن أي إصابة أو خسارة أو مطالبة أو أي أضرار مباشرة أو غير مباشرة أو عرضية أو تأديبية أو خاصة، بما في ذلك على سبيل المثال لا الحصر خسارة الأرباح أو الإيرادات أو البيانات، الناشئة عن استخدامك لأي من الخدمات أو المنتجات.

General Terms & Access

  • We reserve the right to refuse service to anyone for any reason at any time.
  • You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

Modifications to the Service and Prices

  • Prices for our products are subject to change without notice.
  • We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
  • We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
  • We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.
  • We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
  • We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

Third-Party Tools & User Comments

  • We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement.
  • Any use by you of optional tools offered through the site is entirely at your own risk and discretion.
  • If, at our request, you send certain specific submissions or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.
  • We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

ECU Tuning & Mechanical Disclaimer

  • OFF ROAD / RACING COMPETITION USE ONLY - ECU Unlocking and/or Tuning may not comply with Federal, State, Province, and/or Local laws, ordinances, and regulations. You (The “Customer”) Must take full responsibility to ensure that any modifications or upgrades that you have done to your vehicle conform to all applicable laws and regulations for road use, especially pertaining to safety and emissions. You must understand that “FBO” will not be made liable if your local governing authority deems your vehicle unfit for use on their roads due to a ECU/DME calibration change or “tune”.
  • ECU Unlocking will never change or affect the operation of your vehicle; so when we complete our scope of your vehicle, it will continue to perform at the capacity it did before provided service. Following our work, if an issue arises with your vehicle it will most likely be due to a mechanical fault or installation mistake, not a fault with the unlock service itself.
  • All ECUs presented for unlocking will be deemed fit before receiving and it is not the responsibility of FBO or its authorized agents to prove so. It is the responsibility of the customer to ensure that sent ECU is in perfect working condition and not mechanically opened or altered from its manufacturing conditions.
  • Any unforeseen damage that may occur during or after the process is not covered or guaranteed by FBO or its authorized agent. We will not accept liability for any parts, labor charges or time loss after concluding our services.
  • We reserve the right to refuse performing our services if we believe sent ECU is not fit based on above highlighted conditions. No warranty is given or implied to any components on your vehicle before or after the process. Refunds are not accepted. FBO or its authorized agents do not accept liability for any mechanical or electrical part failure after concluding our service. By using our service, you agree to these terms and conditions.
  • The Client must accept FBO or its authorized agents are not liable for delay costs associated to shipping and turnaround time.
  • You also agree that the original vehicle manufacturer makes its own determinations regarding the effects of Add-On products and/or service to its warranties, FBO or its authorized agents shall in no way be held responsible nor liable for anything pertaining to or resulting from the original vehicle manufacturers warranty and/or terms of use.

Limitation of Liability

  • We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
  • You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are provided 'as is' and 'as available' for your use.
  • In no case shall FBO, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, arising from your use of any of the service or any products procured using the service. Because some countries or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such countries or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
